This Notice describes how Uber Works Inc. (“UWI”), a wholly owned subsidiary of Uber Technologies Inc., and its subsidiaries and affiliates collect and use personal data in connection with the Uber Works mobile apps and website(s) (collectively, the "Services"). Through the Services, Uber Works provides a marketplace through which those who submit applications to fill shifts (“Workers”) are connected to those who post Shifts (“Businesses”). For purposes of this marketplace, Workers are employed by third parties (“Employers of Record”) and are not employed by either UWI, Uber, or a Business.
Scope and application
This Notice applies to UWI’s processing of personal data in connection with the use of the Services by Workers, Businesses, or other individuals using the Services (“Users”). This Notice does not apply to any other processing of personal data by UWI, or processing of personal data by Employers of Record. The processing of personal data by Employers of Record is governed separately by the respective Employers of Record privacy notices.
Uber Works Inc., a wholly owned subsidiary of Uber Technologies Inc. (1455 Market Street, San Francisco, CA, 94103, USA), is the data controller for the personal data collected in connection with the use of these Services.
Data collection and uses
Data provided by Users
We collect information provided directly by our Users, including when they:
- Create, modify, or log in to their account
- Request support from or otherwise communicate with us
- Submit schedule availability, sign up for a shift, clock in or clock out of a shift, or complete a review of a shift
- Post shifts on behalf of a Business
This information may include name, email, birthdate, Social Security Number, driver’s license, phone number, postal address, profile picture, position or occupation, information about training or qualifications, shift preferences, ratings given to a Worker or shift, and other information Users may choose to provide.
We also collect documents or information from Workers in order to facilitate their employment with an Employer of Record or shifts with a Business, including:
- Data needed to input and process onboarding and employment, such as Form I-9 Employment Eligibility Verification and associated documents to establish eligibility to work; and
- Any other information requested or required by the Business to complete onboarding
Data created during use of our services
We collect personal data when Users use the Services, including:
- Location information: The UWI app requests permission to access Workers’ location services through the permission system used by their mobile operating system. If granted, UWI collects the precise location of Workers’ devices and uses that information to display shifts available near them and to ensure that their hours are properly logged. Workers will not be able to use the UWI Services if they do not permit location information collection. Workers may disable this collection at any time using the permission system used by their mobile device.
- Device information: We may collect information about the device used to access the UWI Services, including, for example, the hardware model, operating system and version, software and file names and versions, preferred language, unique device identifier, advertising identifiers, serial number, device motion information, and mobile network information.
- Camera permission: UWI requests camera permissions on Workers’ devices to allow them to upload photos of documents relevant to complete their UWI application. UWI will have access to these images and will collect, store, and share this information with the Employer of Record in order to process completed UWI applications.
- Information about Workers’ use of the services: UWI collects transaction details related to Workers’ use of the Services, including the shift selected, the date and time of their shift, times clocked in and out, break periods, amounts earned, ratings, and other related transaction details.
- Support calls: Our Services facilitate communications between Users, including the usage of telephone calls or SMS. In connection with facilitating this service, we may receive call and SMS data, including the date and time of the call or SMS and the parties' phone numbers.
- Log information: When Users interact with the Services, we collect server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service being used before interacting with the Services.
Most mobile device platforms (iOS, Android, etc.) have defined certain types of device data that apps cannot access without the device owner’s permission, and these platforms have different methods for how that permission can be obtained. iOS devices notify Users the first time the UWI app requests permission to access certain types of data and gives Users the option to grant or refuse permission. Android devices notify Users of the permissions that the UWI app seeks before their first use of the app, and use of the app constitutes a grant of such permission.
Data from other sources
We may also receive information from other sources and combine that with information we collect through the Services. For example:
- We may receive information about Workers from their Employer of Record. This includes information about Workers’ application process, shift performance, payments received, or other information related to their employment status.
- We receive information about Workers from the Businesses for whom they work shifts. This includes information about Workers’ location, and about Workers’ rating or similar reviews of the services performed in connection with the UWI app.
- If a User interacts with other Uber products and services, for instance to request or provide services through other Uber apps, we may combine or associate that information with information we have collected in connection with their use of the Services.
Uber’s purposes for using the data it collects include to:
- Provide, maintain, and improve the Services, including, for example, to facilitate payments, provide products and services (and send related information), develop new features, provide customer support, develop safety features, authenticate Users, and send product updates and administrative messages
- Track the shifts completed through the Services, and to determine other information relating to use of the Services, such as payment owed for shifts completed
- Send or facilitate communications between users, such as communications about shifts accepted
- Send Users communications we think will be of interest to them, including information about products, services, promotions, news, and events of UWI and other companies, where permissible and according to local applicable laws
Some of UWI’s products, services, and features require that we share information with Businesses or other Users. We may also share information with our affiliates, subsidiaries, and partners, for legal reasons or in connection with claims or disputes. UWI may share the information we collect:
With other users: This includes sharing information with other Businesses, Employers of Record, or with third parties who require, request, or utilize such information in connection with shifts arranged through UWI. For instance, we may share a Worker’s name, rating, acceptance of a shift, and certain contact information (depending on their location and applicable laws) with Businesses who require, request, or utilize such information in order to determine whether the Worker meets the requirements for a shift.
At the user’s request: This includes sharing information with UWI business partners. For example, if a User requests a service through a partnership or promotional offering made by a third party, UWI may share certain information with those third parties. This may include, for example, other services, platforms, apps, or websites that integrate with our APIs; those with an API or service with which we integrate; or other UWI business partners and their Users in connection with promotions, contests, or specialized services.
With the general public: Questions or comments from Users submitted through public forums such as UWI blog posts and UWI social media pages may be viewable by the public, including any personal information included in the questions or comments submitted by a User.
With UWI subsidiaries and affiliates: We share information with our subsidiaries and affiliates to help us provide our Services or conduct information processing on our behalf. For example, UWI processes and stores information in the United States on behalf of some of its international subsidiaries and affiliates.
With UWI service providers and business partners: UWI provides information to vendors, consultants, marketing partners, research firms, and other service providers or business partners. These include:
- Payment processors and facilitators
- Cloud storage providers
- Marketing partners and marketing platform providers, including social media advertising services
- Data analytics providers
- Research partners, including those performing surveys or research projects in partnership with UWI or on UWI’s behalf
- Vendors that assist UWI to enhance the safety and security of its apps
- Consultants, lawyers, accountants, and other professional service providers
- Insurance and financing partners
With consent: UWI may share a User’s information other than as described in this notice if we notify the User and they consent to the sharing.
- Authenticating Users
- Remembering User preferences and settings
- Determining the popularity of content
- Delivering and measuring the effectiveness of advertising campaigns
- Analyzing site traffic and trends, and generally understanding the online behaviors and interests of people who interact with our services
Choice and transparency
Users may correct their account information at any time by logging in to their online or in-app account.
We request permission for UWI collection of location information from Users’ devices (whether their own device or otherwise) per the permission system used by their mobile operating system. If a User permits the collection of this information, they can later disable it by changing the location settings on their mobile device. However, they will not be able to use the UWI Services if they disable collection of location information.
Changes to the Notice
We may change this Notice from time to time. The continued use of the Services after such change constitutes consent to the changes. We encourage our Users to periodically review this Notice for the latest information on our privacy practices.
